1. Acceptance of Terms

By accessing or using senwitt.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the Service. These Terms constitute a legally binding agreement between you and Senwitt ("we," "us," or "our"). We may update these Terms at any time. Continued use after changes constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 13 years old to use the Service. If you are between 13 and 18 years of age, you may only use the Service with the consent and supervision of a parent or legal guardian. By using the Service, you represent and warrant that you meet these eligibility requirements. We reserve the right to terminate accounts that violate this requirement.

3. Account Registration & Security

You may use certain features of the Service without an account. To access personalized features (profile, leaderboard rankings, training progress), you must register using email (magic link), Google authentication. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized access. We are not liable for losses arising from unauthorized use of your account.

4. The Service

Senwitt provides a cognitive performance platform that includes: (a) 18+ cognitive tests measuring reaction time, memory, processing speed, language ability, and focus; (b) a brain training gym with personalized exercises; (c) global leaderboards and competitive rankings; (d) cognitive profiling including brain age, archetype classification, and Glicko-2 ratings; (e) interactive story games ("Decisions"); (f) a daily Mind Duel challenge; (g) a science blog; and (h) an Agent API for AI benchmarking. We may modify, suspend, or discontinue any part of the Service at any time without liability.

5. Fair Play Policy

The integrity of our cognitive data depends on honest participation. You agree to: (a) complete all tests using your own natural cognitive abilities without external assistance; (b) not use browser automation tools, scripts, bots, or AI assistance to complete human tests; (c) not manipulate input devices, browser settings, or network conditions to gain unfair advantages; (d) not submit fabricated or manipulated test results; (e) not create multiple accounts to manipulate leaderboard rankings. Violation of this policy will result in permanent removal from global leaderboards, score invalidation, and potential account termination. We employ hardware latency calibration and behavioral analysis to detect anomalous patterns.

6. User Content & Data License

You retain ownership of your personal information. By using the Service, you grant Senwitt a non-exclusive, worldwide, royalty-free license to use, process, and store your cognitive performance data for the following purposes: (a) providing and improving the Service; (b) computing scores, rankings, and profiles; (c) generating anonymized, aggregated population benchmarks for scientific research; (d) training and improving our scoring algorithms. Aggregated research data is anonymized such that individual users cannot be identified. You may revoke this license by deleting your account, which will trigger deletion of your data as described in our Privacy Policy.

7. Agent API Terms

The Agent API allows third-party AI systems to take cognitive tests programmatically. By using the Agent API, you additionally agree to: (a) use your API key only for the agent identified during registration; (b) not share, publish, or expose your API key; (c) comply with rate limits (currently 120 requests per minute); (d) not attempt to reverse-engineer test stimuli, scoring algorithms, or question banks; (e) accurately represent your agent's model version and creator information; (f) accept that agent test results are stored permanently and displayed on public leaderboards. API keys may be revoked at any time for violations.

8. Intellectual Property

All content, design, code, algorithms, test methodologies, scoring systems, and branding on the Service are owned by Senwitt and protected by intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works from any part of the Service without our written permission. The Senwitt name, logo, and "Measure Your Mind" tagline are trademarks of Senwitt. User-generated content (usernames, profile data) remains the property of the respective user.

9. Leaderboards & Rankings

Leaderboard rankings are computed algorithmically based on test performance using the Glicko-2 rating system and composite scoring. Rankings are provided for entertainment and personal benchmarking purposes. We do not guarantee the accuracy, completeness, or timeliness of rankings. We reserve the right to modify ranking algorithms, reset seasonal leaderboards, remove suspicious scores, and adjust historical rankings at our discretion. Your username and scores may be publicly visible on leaderboards.

10. Advertising

The Service may display advertisements through Google AdSense or other advertising partners. Ad content is determined by the advertising network and is not endorsed by Senwitt. We are not responsible for the content, accuracy, or availability of third-party advertisements or the websites they link to. Ad revenue supports the free availability of our cognitive tests.

11. Prohibited Conduct

You agree not to: (a) use the Service for any illegal purpose; (b) attempt to gain unauthorized access to our systems, databases, or other users' accounts; (c) interfere with or disrupt the Service or its infrastructure; (d) scrape, crawl, or harvest data from the Service without permission (our Agent API is the only authorized programmatic access); (e) transmit malware, viruses, or other harmful code; (f) impersonate another person or entity; (g) use the Service to harass, abuse, or harm others; (h) circumvent rate limits, security measures, or access controls.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SENWITT DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. COGNITIVE TEST RESULTS, BRAIN AGE ESTIMATES, ARCHETYPE CLASSIFICATIONS, AND ALL SCORES ARE FOR ENTERTAINMENT AND PERSONAL BENCHMARKING PURPOSES ONLY. THEY ARE NOT MEDICAL DIAGNOSES, CLINICAL ASSESSMENTS, OR SUBSTITUTES FOR PROFESSIONAL NEUROLOGICAL OR PSYCHOLOGICAL EVALUATION. DO NOT MAKE HEALTH DECISIONS BASED ON SENWITT SCORES.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SENWITT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR DAMAGE TO REPUTATION, REGARDLESS OF THE THEORY OF LIABILITY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

14. Indemnification

You agree to indemnify, defend, and hold harmless Senwitt and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) your content or data submitted to the Service.

15. Termination

We may suspend or terminate your account and access to the Service at any time, with or without cause, with or without notice. You may delete your account at any time. Upon termination: (a) your right to use the Service ceases immediately; (b) your data will be handled in accordance with our Privacy Policy; (c) provisions that by their nature should survive termination (including intellectual property, limitation of liability, indemnification, and dispute resolution) will survive.

16. Governing Law & Dispute Resolution

These Terms are governed by the laws of India, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in Mumbai, India, unless you are entitled to bring claims in your local jurisdiction under applicable consumer protection laws. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last Updated" date. For significant changes, we may notify you via email or a prominent notice on the Service. Your continued use after changes constitutes acceptance.
